Child Custody in Oklahoma City
When parents are divorcing, an important issue that takes time and thought is child custody in Oklahoma City. A court may order joint or sole custody based on the best interests of the child and the court will also give consideration to the preference of the child. There is no presumption for or against joint or sole custody in Oklahoma City. Custody or visitation with a child will not be granted if it is established that it will expose the child to a risk of harm.
Parents are usually the parties named in child custody agreements, though grandparents and other guardians may have the right to seek child custody under certain circumstances.
When awarding Oklahoma child custody to either parent the court may consider the following:
- Which parent is more likely to allow frequent and continuing contact with the noncustodial parent
- That there is no preference of one parent over the other as a custodian because of the gender of that parent
- The court may provide for the visitation of the noncustodial parent unless it is not in the best interest of the children
Child support
There are official child support guidelines for determining the proper amount of child support. The amount shown in the guidelines is presumed to be correct unless it is shown to be unjust, unreasonable, inappropriate, or inequitable.
The parent who is awarded custody of the child must provide for the education and support of the child. If that support is inadequate, the noncustodial parent must assist in the support. When making a decision about child support, the court will consider the income and means of the parents, and the property and assets of the parents.
Modification
An Oklahoma City child custody order or child support order may be modified or changed. The court will examine whether circumstances render the change proper and if it is in the best interest of the child to do so.
